- A trademark is a brand name or logo which identifies your product or services. It can be a word, letter, number, phrase, symbol, shape, or combination thereof. A unique brand name or logo is used to differentiate your product or service as distinct from others in the industry. To secure legal protection for your brand name or logo you need to get it registered.
- What trademarks are NOT registerable?
- Any trademark, which is identical or deceptively similar to an existing registered trademark or trademark for which application for registration has been made, cannot be registered. Also, a trademark that would likely cause deception or confusion or is offensive may not be registered. Geographical names, common names, common trade words, and common abbreviations can also not be registered as a trademark.
- Can I register a trademark before starting a business?
- Yes, you can register a trademark before even starting a business.
- My trademark will be valid for India or in the world globally?
- No, the Trademark will be valid in India only.
- My trademark will be valid forever or is there any time limit?
- No, the trademark will be valid only for 10 years. After which you need to renew it.
- What is the meaning of the symbol R or TM and how will I use it?
- R means Registered.
- TM means you have filed an application for trademark registration.
- R can be used only after registration of a trademark.
- TM can be used just after filing the trademark application.
- What includes in the trademark?
- An made-up word or any arbitrary dictionary word or words, which is not directly descriptive of quality of the goods or service.
- Letters or numbers or any combination of both.
- Monograms
- Devices or symbols
- Shape of goods or the packaging.
- 3D signs.
- Graphically represented sound marks.
- A single color or a combination with a word/device/symbol.
- Any name (including personal or surname of the applicant or predecessor in business or the signature of the person), which is not unusual for trade to adopt as a mark.
- What trademark applications are commonly rejected?
- If your trademark is similar to an existing application, would hurt religious sentiments, contains geographical names, or common words. It would also be rejected if it is likely to confuse.
- What if my trademark is already taken by others, but under a different class?
- If your brand name has already been registered by someone, but under a different class, you have still a chance. Unless the brand is too well known (like McDonald’s or Honda), your application is likely to get approved.
- Do you guarantee that my trademark application will get approved?
- It depends entirely on the government’s judgment, but if it is unique, it is highly likely that it will be granted.
- How long does it take to get my trademark registered?
- It can take anywhere between 6 months to 1 year for your trademark to be approved, however, you can start using TM just after the application.
