Patent filing

A patent gives you the exclusive right to an invention in India for 20 years from filing, if it's new, involves an inventive step and can be made or used in industry. We run a patentability search and prepare your application with a registered patent agent we work with, who drafts the specification and claims. You can start with a provisional application to secure your filing date, then file the complete specification within 12 months.

  • Patentability search before you file
  • Specification drafted by a registered patent agent we work with
  • Provisional filing to fix your priority date
  • Lower government fees where you qualify as a startup or small entity
  • 4.9 on Google (222 reviews)

How it works

  1. 1

    Invention disclosure

You walk us and the patent agent through the invention, in confidence, with any drawings or prototypes.

  2. 2

    Patentability search

We search patents and published literature for the closest earlier work, and tell you whether the invention looks new and inventive and what could be claimed.

  3. 3

    Drafting

The patent agent drafts the provisional or complete specification. You review it to make sure it describes the invention fully.

  4. 4

    Filing

We file the application and forms with the Indian Patent Office and send you the application number and filing date.

  5. 5

    Publication and examination

The application is published 18 months after the priority date, or earlier on request. Once examination is requested, the Patent Office issues an examination report, which is answered with the patent agent.

Provisional or complete specification

A provisional specification describes the invention and fixes your filing date, which matters because a patent goes to whoever files first. It suits an invention that is still being developed or that you need to show to others soon. The complete specification, with the claims that define what is protected, must follow within 12 months, or the application is treated as abandoned.

If the invention is finished, you can file the complete specification straight away. Either way, the Patent Office examines the application only after a request for examination is filed. That request has its own deadline counted from the priority date, which we diarise for you.

What can be patented

An invention must be new, involve an inventive step that isn't obvious to a skilled person, and be capable of industrial application. The Patents Act, 1970 also lists things that aren't inventions, including mathematical and business methods, computer programs as such, and plants and animals.

Don't publish, sell or present the invention before filing, because public disclosure before the filing date can destroy novelty. Indian residents must also file in India first, or get the Patent Office's permission, before applying abroad.

Who drafts your patent

Under the Patents Act, only a registered patent agent may draft patent documents and act before the Controller on someone else's behalf; inventors can also file their own. We work with a registered patent agent: the agent drafts the specification and claims and signs the filing, and we handle the paperwork, fees, deadlines and your questions.

A granted patent lasts 20 years from the filing date, as long as the annual renewal fees are paid from the third year onwards.

Frequently asked questions

Do you draft patents yourselves?

Patent drafting is done by a registered patent agent we work with, as the Patents Act requires. We coordinate the search, forms, fees and deadlines, and remain your point of contact.

Is a provisional application enough?

No. It secures your filing date for 12 months. You must file the complete specification within that time, or the application is treated as abandoned.

Can I patent software or an app?

A computer program as such can't be patented in India. An invention that uses software to produce a technical effect, such as improving how a device works, may be patentable. The search and the patent agent's view tell you which side of the line you're on.

Can I talk about my invention before filing?

Only under a confidentiality agreement. Public disclosure before filing can make it unpatentable, so file first, then pitch.

How long does it take to get a patent?

It depends on when examination is requested, the Patent Office's queue and the objections raised. Startups and some other applicants can ask for expedited examination. The Controller decides, so we don't promise a grant date.

Does an Indian patent protect me abroad?

No. Patents are territorial. You can use your Indian filing date to apply in other countries within 12 months, directly or through a PCT international application. Ask us for a quote.
